What data do we collect?

We collect and process personal data about you when you interact with us or via our services.

Information you provide directly:

Your name, email address, phone number, location and experiences with our services and products. We collect this information in a number of ways, including when you enter it while using the contact form on our website or while interacting with our customer service;

Your contact or marketing preferences (including any consents you have given us), for example when you sign up for our newsletter;

Your payment details to facilitate payments;

Your educational and employment background, job interest data and personal or professional interests. When you apply for a job with NEP;

In certain regions, e.g. the United States, we may, when you apply for a job with NEP, process diversity and inclusion data that you voluntarily provide us with for the purposes of our diversity and inclusion initiatives. Your responses, or your choice to not respond, will not be associated with your specific application and will not, in any way, be used in the hiring decision.

Information we collect automatically:

Information such as device type, operating system type, browser type, device ID, IP address and other software and hardware information including type, version, language, settings and configuration.

Personal information collected through first- and third-party cookies stored on your devices. Please see our cookie policy on how we use cookies and similar technologies.

Information obtained from other sources: we also receive information about you from other sources to the extent permitted by applicable law, including through our vendors, publicly available sources, and other third parties, e.g. the references you provide to us when you apply for a job with NEP, which we can combine with other information we receive about you. We will generally only collect personal data directly from you, unless in our opinion it is unreasonable or impracticable to do so. If we collect personal data about you from another source, we will ensure that we act in accordance with applicable data protection laws and this Privacy Notice.

For what purposes do we use your data

We process this personal data for the following purposes:

Contractual obligations: for the performance of a contract or in order to take steps prior to entering into a contract with you.‍

As required to establish and fulfil a contract with you. This may include verifying your identity, taking payments, communicating with you, providing customer services, processing your job application and arranging the delivery or other provision of products, goods or services;

When you apply for a job with us, where permitted by the law of the country of the job position which you apply for we may conduct background checks, which may include verification of skill proficiency, criminal history, financial history and other information that may be necessary for determining your qualifications and eligibility.

Legitimate interest: for the purposes of legitimate interests pursued by NEP or by third parties.‍

Prior informed consent: consent is given by you for the processing of your information for one or more specific purposes.

We can collect and use personal information based on your consent. We may send you direct marketing communications in relation to our relevant products and services, or other products and services provided by us, our affiliates and carefully selected partners. Where required by applicable law, these will be sent where you have provided your consent.

If you are based in a part of the world, e.g. Singapore, where local privacy laws mainly demand consent as the lawful basis for processing your personal data, you consent by continuing to use our website or by continuing to interact with the local NEP entity to the collection, use and disclosure of your personal information in accordance with the purposes set out in this Privacy Notice.

Who will we share this data with

We may share your personal data as described in this policy with group companies and third parties, e.g. affiliates of NEP as necessary to provide services or products to you or for the internal operations of NEP.

Personal data may be shared with government authorities and/or law enforcement officials if required for the purposes above, if mandated by law or if required for the legal protection of our legitimate interests in compliance with applicable laws.

Personal data may also be shared with third party service providers, who will process it on behalf of NEP for the purposes above. Such third parties include, but are not limited to, providers of website hosting, maintenance, call centre operation, identity checking etc.

Personal data may also be shared with others in connection with, or during negotiations of any merger, sale of company assets, consolidation or restructuring, financing, or acquisition of all or a portion of our business by or into another company.

When you apply for a job with us, we will share your information with the following categories of third parties where necessary to manage our recruitment process: relevant NEP group entities, our service providers (such as Workday, Concur and Greenhouse) and professional advisers (e.g. recruitment agencies, providers who carry out background checks on our behalf, and, if applicable to the role you are applying for, suppliers who run candidate assessment programs for us).

We will also contact third parties whose details you have supplied so that we can verify information you have supplied in relation to your previous employment and qualifications.

Data transfers

Personal information provided to NEP may be transferred across state and country borders e.g. to perform a service you request from us, to follow-up on your enquiries, for the purposes of data storage and simplified information management and with other NEP group entities or service providers to manage our recruitment process when you apply for a job.

Where personal information of EU respectively UK data subjects is transferred outside the EEA respectively the UK, and where this is to a NEP affiliate or vendor in a country that is not subject to an adequacy decision by a relevant body such as the European Commission (read more here), data is adequately protected by approved standard contractual clauses such as those approved by the European Commission (read more here) or a vendor's Binding Corporate Rules (read more here).

If you are not an EU or UK data subject and your personal information is transferred from the country in which you are located to another country, NEP will put in place measures to ensure that such transfers take place in compliance with applicable local standards in the jurisdiction that you are located in.

How we protect your data

What rights you have in relation to your data

You may be entitled to ask NEP for a copy of your information, to correct it, erase or restrict its processing, or to ask us to transfer some of this information to other organisations. You may also have rights to object to some processing activities, such as the profiling we may perform for the purposes of direct marketing and where we have asked for your consent to process your data, to withdraw this consent. These rights may be limited in some situations – for example, where we can demonstrate that we have a legal requirement to process your data. Prior to processing your request, we may contact you for further information in order to verify and confirm your request. We cannot respond to your request if we are unable to verify your identity or authority to make the request. We will only use personal data provided in a request to verify the identity or authority to make the request.

Where we require personal data to comply with legal or contractual obligations, the provision of such data is mandatory: if such data is not provided, we will not be able to manage our contractual relationship, or to meet obligations placed on us. In all other cases, provision of requested personal data is optional.

Your information is not used in any automated decision making (a decision made solely by automated means without any human involvement) that produces legal effects or otherwise significantly affects you.

How long we retain your data

Where you are a customer, NEP will keep your information for the duration of any contractual relationship you have with us, and, to the extent permitted, after the end of that relationship for as long as necessary to perform the purposes set out in this notice. For data about your visits to our websites or applications, NEP will retain this for as long as is reasonably necessary for the relevant purpose.

When you apply for a job with NEP, NEP retains your personal information for as long as needed to process your application. If your application results in employment with us, the information provided may be retained for purposes of your employment. Unless you indicate otherwise, we will also retain your personal information in accordance with our data retention policy to consider your candidacy for other positions that may be of interest to you.

Laws may require NEP to hold certain information for specific periods. In other cases, NEP may retain data for an appropriate period after any relationship with you ends to protect itself from legal claims, or to administer its business.
